Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Volume Booster mobile application (the "App") operated by Appcellent Yazilim Hizmetleri A.S. ("Appcellent," "we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

The App is an audio enhancement tool that allows you to boost volume beyond device limits, adjust bass levels, customize audio with a 6-band equalizer, control playback speed, and export processed audio.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must be at least 13 years of age to use the App. If you are under 18, you must have your parent's or guardian's permission to use the App.

2. Account and Data

Your preferences, audio settings, and equalizer presets are stored locally on your device. You are responsible for maintaining the security of your device and the data stored on it.

3. Subscriptions and In-App Purchases

3.1 Premium Subscription

The App offers premium subscription plans that unlock additional features, including but not limited to: Volume Boost, Bass Boost, 6-Band Equalizer, Playback Speed Control, Audio Export, and Waveform Visualization.

3.2 Subscription Plans

Subscription options and pricing are displayed within the App at the time of purchase. Prices are subject to change, and any changes will be communicated before your next billing period.

3.3 Free Trial

We offer a 3-day free trial for eligible users. At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.

3.4 Billing and Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
  • You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Prices are in US dollars (USD) and may vary in other countries. Actual charges may be converted to your local currency depending on your country of residence.

3.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

3.6 Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple in accordance with their refund policies.

4. Audio Processing and Safety

4.1 Audio Processing

All audio processing — including volume amplification, bass boost, equalizer adjustments, and speed changes — is performed entirely on your device. Audio quality results depend on the quality of the source audio file.

4.2 Hearing Safety Warning

IMPORTANT: Extended listening at elevated volume levels may cause permanent hearing damage. The App allows you to amplify audio beyond the standard device volume limits. You acknowledge and accept full responsibility for your listening volume and duration.

We strongly recommend:

  • Starting at lower volume levels and gradually increasing as needed.
  • Taking regular breaks during extended listening sessions.
  • Following the World Health Organization's safe listening guidelines.
  • Consulting a healthcare professional if you experience ringing, muffled hearing, or discomfort.

APPCELLENT IS NOT LIABLE FOR ANY HEARING DAMAGE, HEARING LOSS, OR RELATED HEALTH ISSUES RESULTING FROM THE USE OF THIS APP.

4.3 Music Library Access

The App requires your permission to access your Apple Music library for playback purposes. Audio files are processed on-device only. The App does not modify, delete, or upload your original music files.

5. Intellectual Property

5.1 App Content

The App, including its design, features, code, and original content, is the property of Appcellent and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5.2 User Content

Any audio you export using the App remains your property. You are responsible for ensuring you have the rights to the source audio you process and export. Appcellent is not responsible for any copyright infringement resulting from your use of the export feature.

6. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the App's functionality or infrastructure.
  • Use automated systems, bots, or scripts to access or interact with the App.
  • Circumvent or attempt to circumvent subscription restrictions or payment requirements.
  • Redistribute or commercially exploit processed audio without proper rights to the source material.
  • Use the App to infringe upon the intellectual property rights of others.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AUDIO PROCESSING RESULTS WILL MEET YOUR EXPECTATIONS OR THAT THE APP WILL BE COMPATIBLE WITH ALL AUDIO FORMATS OR DEVICES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPCELLENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO ANY HEARING DAMAGE OR HEALTH ISSUES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Appcellent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appcellent regarding your use of the App and supersede any prior agreements.
